NO SUBSCRIPTION, PURCHASE OR ONLINE ENTRY REQUIRED TO ENTER OR RECEIVE A PRIZE. A PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING.

These Official Rules apply for the Eucerin Sweepstakes promotion (hereinafter, “Sweepstakes”) conducted by Martha Stewart Living Omnimedia, Inc., 11 West 42nd Street, New York, NY 10036 (“Sponsor”) which will be promoted at www.marthastewart.com/living-marketplace/myeucerin (the “Website”) and in the October 2008 and November 2008 issues of Martha Stewart Living Magazine. The Sweepstakes will start at 12:00 AM Eastern Daylight Savings Time (“EDT”) on September 15, 2008 and will end at 11:59:59 PM Eastern Standard Time (“EST”) on November 30, 2008. By entering this Sweepstakes, you agree to the Terms in these Official Rules.

SWEEPSTAKES ENTRANTS AND PRIZE RECIPIENTS MUST BE LEGAL RESIDENTS OF ONE OF THE FORTY-EIGHT (48) CONTIGUOUS UNITED STATES OR THE DISTRICT OF COLUMBIA, AGED 18 YEARS OR OLDER AT THE TIME OF ENTRY TO BE ELIGIBLE. VOID IN AK AND HI, OUTSIDE THE UNITED STATES, AND WHERE PROHIBITED BY LAW. SWEEPSTAKES SUBJECT TO ALL APPLICABLE FEDERAL, STATE AND LOCAL LAWS AND REGULATIONS. Employees of Sponsor, Eucerin® (“Promotional Partner”), and each of their respective parent companies, subsidiaries, affiliates, divisions, advertising and promotion, fulfillment and/or judging agencies, and related entities, and their immediate families are not eligible.
HOW TO ENTER: Via the Internet (“Online Entries”): Visit www.marthastewart.com/living-marketplace/myeucerin and electronically follow the instructions found on the Official Entry Form Screen and submit your Online Entry as directed by 11:59:59 PM EST on November 30, 2008. Entrants will be required to provide their complete name, home address, daytime and evening phone numbers, a valid e-mail address and date of birth. Limit one (1) entry per email address per day. Your entry constitutes your consent to participate in this Sweepstakes and your consent for Sponsor to obtain and deliver your name, address and other information to Centra Marketing and Communications, LLC for the purpose of administering this Sweepstakes and for other uses by Sponsor as permitted by applicable law. Entries are the property of the Sponsor and will not be acknowledged or returned. Sponsor is not responsible for lost, late, incomplete, misaddressed, or otherwise misdirected entries that are processed late or incorrectly or are lost due to computer or electronic malfunction or other error. The Online Entries may contain survey questions; while it is requested that you answer all survey questions, answers to survey questions are not required in order to enter the Sweepstakes. Website registrants that access the Website from a computer located in one of the forty-eight (48) contiguous United States or the District of Columbia will receive one (1) entry per day each day they access the Website between 12:00 AM EDT on September 15, 2008 and 11:59:59 PM EST on November 30, 2008.
SELECTION OF GRAND PRIZE WINNER: Grand Prize Winner will be selected in a random drawing from among all eligible entries received. The random drawing will be conducted on or about December 15, 2008. The random drawing will be conducted by Centra Marketing & Communications, LLC, an independent judging organization whose decisions on all matters relating to this Sweepstakes are final and binding in all respects pertaining to this Sweepstakes. Odds of winning depend on the number of eligible entries received. The Grand Prize will be awarded provided a sufficient number of eligible entries are received.
ONE (1) GRAND PRIZE: Grand Prize is a “Healthy Foundations Lifestyle Makeover” consisting of one (1) session with a Healthy Living Expert, one (1) session with an expert on Healthy Cooking 101, one (1) session with a local personal trainer, one (1) skin care consultation with an Eucerin expert, and one (1) customized Eucerin Gift Basket as designated by Sponsor. The approximate retail value of the Grand Prize: up to $4,275. Any difference between stated approximate retail value of the Grand Prize and actual value will not be awarded. All expenses and costs associated with the acceptance and use of Grand Prize will be the sole responsibility of the Grand Prize Winner. Grand Prize Winner will be solely responsible for any and all ground transportation to attend any sessions or consultations stated herein. Grand Prize Winner will be solely responsible for all federal, state and local taxes on prize. No cash substitution, assignment, or transfer of any prize permitted.
CLAIMING PRIZE/RELEASE: Potential Grand Prize Winner will be notified by U.S. Mail delivery on or about December 22, 2008. Grand Prize Winner will be required to execute and return an Affidavit of Eligibility and a Liability and Publicity Release (unless prohibited by law) to Centra Marketing & Communications within ten (10) business days of notification. If the selected potential Grand Prize Winner’s notification or the Grand Prize is returned as undeliverable, the potential Grand Prize Winner is ineligible, or the Grand Prize Winner declines the prize or fails to comply with the Official Rules and/or to submit required documentation within the designated period, the Potential Grand Prize Winner will be disqualified and the prize will be awarded to an alternate potential Grand Prize Winner in a random drawing from among all remaining eligible entries. Sponsor is not responsible for fraudulent calls or e-mails made to entrants not by the Sponsor.
INTERNET: If for any reason this Sweepstakes is not capable of running as planned due to an infection by a computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes, at which time, Sponsor will conduct a random drawing from among all eligible entries received at the time of the Sweepstakes termination. The Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor is not responsible for any problems or technical malfunctions of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by the Sponsor due to technical problems, human error or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participating in this Sweepstakes or downloading any materials in this Sweepstakes. SPONSOR IS NOT RESPONSIBLE FOR INCOMPATIBILITY OF ENTRANT’S HARDWARE, SOFTWARE OR BROWSER TECHNOLOGY WITH SPONSOR’S HARDWARE, SOFTWARE OR BROWSER TECHNOLOGY. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity or eligibility of a winner based on an e-mail address, the winning entry will be declared made by the “Authorized Account Holder” of the e-mail address submitted at time of entry. “Authorized Account Holder” is defined as the natural person 18 years of age or older who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization (e.g., business, education institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Use of automated devices are not valid for entry.
GENERAL: By entering this Sweepstakes, entrants and Prize Winner: (1) agree to be bound by these Official Rules; (2) agree to release Sponsor, Promotional Partner, and each of their respective parent companies, subsidiaries, affiliates, divisions, advertising and promotion, fulfillment and/or judging agencies, and related entities, and the employees, directors and officers of each, from any and all liability for any loss, harm, damages, costs or expenses, including without limitation property damages, personal injury and/or death arising out of participating in this Sweepstakes, or the acceptance, possession, use or misuse of any prize and claims based on publicity rights, defamation or invasion of privacy and merchandise delivery; and (3) acknowledge that the stated parties have neither made nor are responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any Prize, including but not limited to its quality, mechanical condition, or fitness for a particular purpose. Sponsor may prohibit individuals from participating in the Sweepstakes and disqualify entries if they (1) attempt to enter the Sweepstakes through any means other than as described in these Rules, (2) attempt to disrupt the Sweepstakes or circumvent the terms and conditions of these Rules in any way or (3) repeatedly show a disregard for the Sweepstakes Rules or act (a) in an unsportsmanlike manner, or (b) with an intent to annoy, abuse, threaten or harass any other entrant or Sponsor. Sponsor and Promotional Partner are not responsible for any printing, typographical, administrative, human or technological errors in or involving any materials associated with this Sweepstakes. Sponsor’s decisions with respect to the Sweepstakes are final.
USE OF INFORMATION: The information that you provide in connection with the Sweepstakes may be used for Sponsor's internal purposes and to send you information about Sponsor’s products and special promotions but will not be provided to third parties, except as necessary for the administration of the Sweepstakes or as required by law or legal process. Entry constitutes permission to post winner’s name on Website and to use winner’s name, Hometown, voice, photograph and/or likeness for purposes of advertising and promotion in any medium throughout the world in perpetuity without further compensation unless prohibited by law.
